Terms of service
These terms are a binding agreement between the Shopify store that installs BookSlot (“you”, the “Merchant”) and Fenloft FZE (“we”, “us”, the “Provider”). By installing or using BookSlot you accept them, together with the privacy policy and the data processing agreement, which form part of this agreement. If you install BookSlot for a company, you confirm that you are authorised to bind it. If you do not agree, do not install BookSlot.
1. Definitions
- “BookSlot” or the “Service”: the BookSlot app for Shopify, including the admin pages inside the Shopify admin, the booking page and blocks it adds to your online store theme, the calendar feeds, the emails it sends on your behalf, this website and any documentation.
- “Customer”: a person who books, requests or manages a booking with your store through the Service.
- “Customer Data”: personal data about your Customers and staff that the Service processes on your behalf, as described in the data processing agreement.
- “Plan”: one of the subscription plans in section 4, with the limits and features shown there and in the app.
- “Shopify”: Shopify Inc. and its affiliates, whose platform the Service runs on and whose terms also bind you.
2. The service
BookSlot lets your store offer appointments, consultations, classes and demos: Customers pick an available time and book instantly or send a request you confirm later; the Service applies your locations, staff hours, time off, buffers and capacity; it sends booking emails, links bookings with your Shopify customers, checkout and orders when you turn those features on, and shows everything in a calendar and list in your Shopify admin. Features vary by Plan. The Service is software you use to run your own booking business; it is not a marketplace, and we are not a party to any arrangement between you and your Customers.
3. Eligibility and your account
- You must have an active Shopify store with the Online Store sales channel, and be at least 18 years old or the age of majority where you live.
- Access to BookSlot is through your Shopify staff accounts. You are responsible for everyone who uses the Service through your store, for keeping their Shopify credentials secure, and for all activity under your store’s installation.
- Calendar feed links and other private links the Service gives you are confidential; keep them private.
- Tell us at once at support@fenloft.com if you suspect unauthorised use.
4. Plans, trials and billing
| Plan | Price | Limits and features |
|---|---|---|
| Free | $0 | 1 location · 1 staff · 25 bookings / month · BookSlot branding |
| Starter | $9 / month | 1 location · 3 staff · 200 bookings / month · No branding · Calendar feed |
| Pro | $19 / month | 5 locations · Unlimited staff · Unlimited bookings · Paid bookings, questions, templates · Google Calendar sync (coming soon) |
- Trial. Every new install starts with a 14-day trial of Pro at no charge. When it ends you choose a Plan; Free needs no charge. Shopify may add its own trial days when you pick a paid Plan; the trial shown on Shopify’s plan page is the one that applies. Trial days are not restored on reinstall if Shopify counts them as used.
- Billing through Shopify. Plans are sold through Shopify App Pricing. Paid Plans are billed by Shopify in US dollars every 30 days, appear on your Shopify invoice, and are subject to Shopify’s billing terms. Prices exclude taxes; Shopify adds VAT, GST or sales tax where it is required to. We never see your card or bank details.
- Changing plans. Settings → Plan & billing in BookSlot opens Shopify’s plan page. An upgrade applies as soon as you approve it and is prorated by Shopify. A downgrade, including to Free, applies at the end of the current 30-day cycle. When you move to a Plan with lower limits, data above the limit is kept but you cannot add more until you are within the limit.
- Refunds. Fees are non-refundable except where Shopify’s billing rules or the law require a refund. If you believe you were charged in error, write to us within 30 days of the charge and we will review it with Shopify.
- Price changes. We may change Plan prices or limits. We will give at least 30 days’ notice by email to the store’s contact address before a change affects a Plan you are on; continuing after the change takes effect means you accept it, and you may downgrade or uninstall before then.
- Features marked “coming soon” are not available yet and are not part of what you buy.
- Paid bookings. Payments for paid bookings go from your Customer to you through your own Shopify checkout. BookSlot is not a party to that sale, takes no commission on it, and does not hold or transmit funds.
5. Your responsibilities
- Use the Service lawfully, only for your own store, and in line with Shopify’s terms and policies.
- Keep your services, prices, hours, locations and booking questions accurate. You are responsible for the appointments you offer and for honouring them, for your own cancellation, rescheduling, no-show and refund rules, for any licences your services require, and for the taxes on what you sell.
- You are the controller of your Customers’ data. Publish a privacy policy for your store that covers bookings, collect only the data you need in your booking questions, do not ask for special categories of data (such as health information) unless you have a lawful basis and have told us, and obtain any consent you need, for example for marketing email.
- Make sure staff who connect a Google Calendar or use a calendar feed are allowed to, that the people named in your staff profiles agree to appear on your booking page, and that you have the right to use any text, images or names you enter into the Service.
- Review the emails the Service sends on your behalf (you can edit the templates on eligible Plans) and keep your reply-to and team addresses current. Emails are sent from our domain in your store’s name.
- Keep your own records of important bookings. You can export bookings and customers as CSV files at any time, and you should do so before uninstalling.
6. Acceptable use
You must not, and must not allow anyone else to:
- use the Service to send spam, unsolicited marketing or messages unrelated to a booking;
- collect, store or process data through the Service that you are not allowed to collect, or data about children where the law forbids it;
- use the Service for anything unlawful, deceptive or harmful, or to offer services that are illegal where you or your Customer are;
- probe, scan, overload or disrupt the Service or its infrastructure, bypass rate limits or access controls, or access another store’s data;
- copy, modify, reverse engineer, resell, sublicense or create derivative works of the Service, or remove any notice on it, except as the law allows;
- use automated means to create bookings or scrape availability other than through your own storefront as intended;
- misrepresent your identity or affiliation, or use BookSlot’s name or marks to suggest an endorsement.
We may investigate suspected misuse and may suspend the Service for a store while we do (section 14), taking care to limit the suspension to what the situation requires.
7. Data protection and your customers’ data
- Your store’s data stays yours. We process Customer Data only on your behalf and on your documented instructions, under the data processing agreement (the “DPA”), which is concluded between you and us when you install BookSlot and which includes the EU Standard Contractual Clauses and the UK Addendum for transfers. If these terms and the DPA conflict about Customer Data, the DPA prevails.
- The privacy policy describes what data the Service collects, why, where it is stored, our sub-processors and how long it is kept. All data is stored and processed in the United States.
- We do not sell personal data, do not use it for advertising and do not use it to train machine-learning models. We may produce aggregate statistics that identify no store or person.
- Shopify’s privacy webhooks (customer data requests, customer deletion, shop deletion) are handled automatically; you do not need to ask us separately for them.
- After uninstall your data is deleted as the privacy policy describes. We have no obligation to keep it beyond those periods.
8. Shopify and other third-party services
- The Service runs on Shopify. Shopify’s terms, its app store terms and its API terms apply to your use of BookSlot, and Shopify controls installation, permissions, billing and the admin in which BookSlot appears. We are not responsible for Shopify’s acts, outages or changes, and Shopify is not responsible for the Service.
- Features that connect to a third-party service (such as Google Calendar) are subject to that service’s terms and depend on its availability. Connecting one is your choice and you can disconnect at any time.
- Links to other websites are provided for convenience; we do not control them and are not responsible for their content or practices.
9. Intellectual property and feedback
- The Service, its code, design, documentation and the BookSlot name and logo belong to the Provider or its licensors and are protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your store while this agreement lasts, and nothing else.
- You keep all rights in your store’s content and data. You grant us the licence needed to host, display, send and process it to provide the Service to you and to the extent the DPA allows, and no wider.
- If you send us feedback or suggestions you grant us the right to use them without restriction or payment; we will not identify you as the source without your consent.
- Open-source components in the Service are licensed under their own terms, which are available on request.
10. Availability, support and changes
- We aim to keep the Service available at all times but do not promise uninterrupted operation and offer no service-level agreement. We may take the Service down for maintenance, preferably at off-peak hours, and will tell you in advance when we can.
- Support is by email in English at support@fenloft.com. We aim to answer within two business days and sooner for issues that stop bookings coming in or involve a wrong charge. We do not offer phone or live chat support.
- We improve the Service continuously and may add, change or remove features. If a change removes or materially reduces a feature you pay for, we will give at least 30 days’ notice by email and you may cancel without penalty before it takes effect.
- We may update these terms. We will change the date at the top and, for material changes, tell you by email at least 30 days before they take effect. Using the Service after that date means you accept the new terms; if you do not, uninstall before then.
11. Warranties and disclaimers
We warrant that we will provide the Service with reasonable skill and care and substantially as described. Otherwise, and to the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements, that bookings will be made, kept or paid, or that emails will be delivered by third-party mail systems. Nothing in this section limits rights that consumer law gives you and that cannot be excluded.
12. Limitation of liability
- To the extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost bookings, lost data or business interruption, however caused and under any theory of liability, even if advised of the possibility.
- To the extent the law allows, our total liability for all claims arising out of or relating to the Service or this agreement in any twelve-month period is limited to the greater of the fees you paid us for the Service in the twelve months before the first claim and one hundred US dollars (USD 100).
- These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for a party’s breach of the DPA to the extent the applicable data protection law does not allow it to be limited.
13. Indemnity
You will defend and indemnify the Provider against third-party claims, and the damages, costs and reasonable legal fees that result, to the extent they arise from your store’s content or booking questions, the services you offer and your dealings with Customers, your breach of these terms or of data protection law as a controller, or your use of the Service in a way we did not authorise. We will tell you promptly of such a claim, let you control the defence and settlement (no settlement may admit fault on our behalf without our consent), and give reasonable assistance at your cost.
14. Term and termination
- This agreement starts when you install BookSlot and lasts until it is uninstalled or ended under this section.
- You can end it at any time by uninstalling BookSlot from your Shopify admin. Uninstalling cancels your Plan; Shopify’s rules decide whether any part of the current cycle is refunded.
- We may suspend or end your access, with notice where practicable, if you materially breach these terms and do not cure the breach within 14 days of our notice, if your use creates a security or legal risk for us or other stores, if Shopify ends access to the app or requires it, or if you fail to pay fees Shopify was unable to collect.
- If we decide to discontinue BookSlot, we will give at least 30 days’ notice by email and keep export available until then.
- On termination your licence ends and your data is deleted as the privacy policy describes. Sections 9, 11, 12, 13, 15 and 16 survive termination.
15. Governing law and disputes
These terms and any dispute arising out of or in connection with them or the Service are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Sharjah, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The parties submit to the exclusive jurisdiction of the courts of the Emirate of Sharjah, United Arab Emirates, except that either party may seek injunctive relief to protect its intellectual property or confidential information in any competent court, and except that the Standard Contractual Clauses in the DPA have their own governing law and forum as stated there. Before starting proceedings, the parties will try in good faith to resolve the dispute by email or a call within 30 days of one party raising it. If you are a consumer under mandatory law in your country of residence, nothing in this section deprives you of the protection of that law or of your local courts.
16. General terms
- Entire agreement. These terms, the privacy policy and the DPA are the entire agreement between you and us about the Service and replace any earlier terms. Shopify’s terms govern your relationship with Shopify.
- Order of precedence. For Customer Data the DPA prevails; otherwise these terms prevail over the privacy policy, and both prevail over any in-app text.
- Assignment. You may not assign this agreement without our consent, except to a successor of your store that also takes over the Shopify account. We may assign it to an affiliate or to a successor of our business on notice to you.
- Notices. We send notices to the contact email of your Shopify store, and you send notices to support@fenloft.com. Notices by email are effective when sent.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including outages of Shopify or of our infrastructure providers, provided it takes reasonable steps to mitigate.
- Severability and waiver. If a provision is unenforceable the rest remains in force and the provision is read as narrowly as needed to be enforceable. A failure to enforce a right is not a waiver of it.
- Export and sanctions. You may not use the Service if you are in a country or on a list that makes it unlawful for us to provide it to you.
- Language. These terms are written in English; any translation is for convenience only.
